If the individual and/or family qualifies for a Advance Premium (subsidy) Tax Credit they can only purchase a health insurance policy through the Government Healthcare Exchange market and the subsidy will be applied to their premium. Should the individual and/or family be declined an Advance Premium (subsidy) Tax Credit they may purchase a health insurance policy from the open private market.
The Approval/Decline decision by the Federal Government is the responsibility of the Internal Revenue Service and three other major Federal Agencies. The Internal Revenue service determines the individual and/or families household income and employment status for consideration of an Advance Premium (subsidy) tax Credit application request. The other three major Federal Agencies that may participate in the review process include Home Land Security in determining citizenship status along with the Justice Department review for criminal history and the Social Security Administration in determining identity of individuals on the application.
